Kenneth Chong Kheng Aik

Kenneth holds a Bachelor of Laws (Hons) and Master of Laws with Distinction (First Class) in Commercial Law, both from Northumbria University, UK. He also holds a Diploma in International Commercial Arbitration from the Malaysian Institute of Arbitrators (MiArb). He was admitted as a Barrister-At-Law of Lincoln’s Inn, London in 2008 and as an Advocate & Solicitor of the High Court of Malaya in 2010. He joined Shen, Eow & Partners in 2010 (subsequently Raslan Loong, Shen & Eow) and was a partner of Raslan Loong, Shen & Eow since 2019 until joining MKP in January 2026.
Kenneth practices in the areas of intellectual property (IP), employment, and dispute resolution. He is a registered Patents, Trademarks and Industrial Designs agent in Malaysia and has extensive experience in IP registration and prosecution matters representing both domestic and foreign clients. He regularly conducts IP enforcement and Anton Piller Order actions. He also provides internal training for the Ministry of Domestic Trade and Consumer Affairs and the Royal Malaysian Customs Department in Malaysia and conducts presentations with local universities, companies and start-ups on various legal related topics.
Kenneth’s experience includes IP invalidation actions, passing-off actions, trademark and trade name infringement matters, IP right prosecutions and enforcement actions, proceedings against counterfeiters and parallel importers, resisting garnishing orders, and copyright infringement claims.
He also works closely with patent drafters, inventors and clients in advising on patent applications and provides prior-art search services, freedom to operate reports and patent infringement reports. In addition, he advises on IP assets matters for tech companies, social media influencers and celebrities.

Personal Involvements:
- Successfully represented a leading safety guard company in securing and obtaining its trademark registration and a legal undertaking from a third party acknowledging the company’s rights as the common law proprietor of the trademark in Malaysia and other countries, whilst concurrently obtaining a favourable decision in an ex-parte hearing for the company’s trademark in Chinese Characters.
- Successfully represented a pioneer premium caregiving and nursing home company in obtaining a trademark registration for its brand in Malaysia and Singapore.
- Successfully represented a subsidiary of a Malaysian public listed company that designs and manufactures electrical products in settling an alleged copyright infringement matter with a German conglomerate software company.
- Successfully represented a professional engineering consultancy firm in amicably settling alleged copyright infringement claims by an international structural design software company based in Turkey.
- Successfully represented a South Korean electronics and semiconductors corporation in IP rights' prosecutions, enforcement actions, and High Court proceedings.
- Successfully represented an arbitrator in challenging a suit filed against it in the High Court.
- Successfully represented a Singaporean public listed company in a constructive dismissal case at the Industrial Court while concurrently reaching a settlement in a libel case in favour of the client.
- Successfully represented a Chinese contractor engaged with a hotel chain to resist and dismiss a garnishing order at the Malaysian court.
- Successfully represented a U.S. ride-hailing company to facilitate and expedite the release of the client's assets unlawfully confiscated by a tax authority.
- Successfully represented an arbitrator to claim the costs of arbitration.
- Successfully resisted a patent invalidation action for a mosquito coil patent in the Court of Appeal.
- Successfully represented a client in a passing-off action, securing exclusive rights to use the client's trade name and trademark against a public listed property developer in the High Court.
- Successfully represented a public listed subsidiary company in an ex-parte hearing and obtaining exclusive rights and use for its trademark and trade name.
